UPDATE: The Orleans Parish district attorney’s office will not prosecute former Loyola student Dylan Rosevear, who was arrested and booked on charges of simple rape in October 2010.

The New Orleans Police Department arrested and booked a Loyola student on charges of simple rape earlier this month.

Police arrested Dylan Rosevear, music performance senior, on Oct. 15 after police say he raped a woman following a Tulane fraternity party.

According to the police report, Rosevear and the victim attended a cocktail party at the Sigma Chi Fraternity house. The victim became intoxicated at the party and one of her friends asked Rosevear to bring her home, due to her intoxication, the report said. The victim woke up nude with Rosevear, also nude, lying next to her in her bed, kissing her on the neck the following morning.

Police said the victim asked Rosevear what happened, which he told her they engaged in sexual intercourse the previous night and showed her a condom on the floor. The victim said she told Rosevear she did not remember anything, and he left, the report said.

After that, the victim contacted her friend and asked how drunk she was when Rosevear brought her home.

“Smashed,” the report said the friend responded. Rosevear, who is still attending classes, and his lawyer declined to comment on the matter. Loyola Student Affairs and University Counseling Center also declined to comment on whether they would take disciplinary action against Rosevear.

“If she is intoxicated to a level where she can’t function, that’s rape,” said Lt. Paul Noel of the NOPD Sex Crimes Unit.

Noel said a rape kit was used in the investigation and no date rape drugs were involved, to his knowledge.

Noel does not believe Rosevear took the victim out to get her intoxicated, but he also said that it is irrelevant as far as the law goes.

Rosevear was released after posting a $10,000 bail. Rosevear’s first appearance hearing in magistrate court will be Dec. 15.

I wish the people who are blaming the victim would sign their posts so the women on campus could know which guys think rape is OK.

What do we know from this article? Do we know that the girl was drunk? Yes. Do we know that she was too drunk to function? No. The comment "If she is intoxicated to a level where she can't function, that's rape" is a general comment on rape in general, not on the case at hand. We also know that the word "smashed" is not specific and could be referring to many levels of intoxication. Could she have been date raped? Yes. Could she have agreed to it and not remember due to alcohol consumption? Yes. We don't know. The Maroon is at fault here for assigning the word "rapist" to a name and a picture without having any grounds for the term.

I can't believe people would be so stupid as to defend a rapist rather than the victim! Just because someone is drunk or hits on someone doesn't mean they are asking for it. That's ridiculous, and it's called victom-blaming. I am absolutely disgusted with all the comments that condemn a poor young woman who was assaulted rather than her rapist. Why are you all so quick to think the woman is the one responsible? Who holds more power here, the rapist or the girl who was clearly too intoxicated to make any kind of decision? What's the bigger crime, having sex with someone without consent or drinking too much? Doesn't she deserve to be treated with respect and sympathy? I am appalled.

So let me get this straight, all those who are defending the accused: If it was a man who got drunk, was taken home by a gay man, woke up naked with this man kissing him, and was told they had had sex the night before, sex he did not remember....that's all totally his fault, right? Since people who are wasted can't say no, it's totally appropriate and right to take advantage of them in any way you want, right? He didn't say no! Maybe he's just ashamed that he had sex with a guy! He shouldn't have had so much to drink!

SERIOUSLY, commenters, please look up the definition of rape and then reread the article and focus on " 'If she is intoxicated to a level where she can't function, that's rape,' said Lt. Paul Noel of the NOPD Sex Crimes Unit." An expert is saying that any level of intoxication mixed in with sex makes up a rape. Unless you're an expert on what rape is and what defines rape, please keep your supposed definition of what constitutes a rape to yourself. Stop making rape apology acceptable--it's NOT. Neither is rape.

This is so wrong. Why is the Maroon printing that someone accused of rape was accused of rape?! It was completely the victim's fault for being raped, not the rapist's!

She shouldn't have been drunk if she didn't want to be raped. She shouldn't have started drinking if she didn't want to be raped. She shouldn't have gone to a party if she didn't want to be raped. Why was she outside of the kitchen anywayz? Wait, isn't she supposed to be taking care of her babies?

Loyola loves to parade around in pretty purple and teal shirts that say how they oppose sexual abuse, and then they turn around and accuse the Maroon of "raping" someone- as if the Maroon was the stone cold sober one who was trusted with taking home a smashed chick and then took advantage of her. We need t-shirts that say "Loyola loves its rapists" instead, and stop the take back the night charade. Stupid hypocrites.

I hope Loyola gets sued over this. And, their excuse for publishing this is bullshit and shameful. This girl probably just got embarrassed that she hooked up with a member of the music program at Loyola. She probably told her "sisters" an exaggerated truth and they probably urged her to go to the police.

Side note: the girl that wrote this article is a terrible writer. If she can get front page, it makes me wonder why this school has a news paper to begin with.

I agree that this is news-worthy, but also that it has to be made more clear that this is an alleged rape. I also think printing the picture was not necessary (especially since it's just a poorly cropped version of his facebook pic).

Do we, as readers of this article, have any evidence of her being unable to function before and/or during intercourse? No. "Smashed" does not necessarily mean unable to function. People can get drunk and not remember things they do. This includes things they agree to and things they do not. This article put the word rapist on someone's head, when all it can prove is that a girl was drunk and had sex. Is this news? No.
